Terms and Conditions
Please read these Terms and Conditions carefully before entering the competition. By entering, the Sailing Club indicates that it accepts these Terms and Conditions and agrees to be bound by them.
- Promoter’s Details: Mariner International Travel (UK) Limited, a member of the Travelopia Group of companies. Registered office: Origin One, 108 High Street, Crawley, West Sussex, RH10 1BD. Registered in England with company number 1239190.
- Eligibility: This competition is open to any sailing and yachts clubs and/or charities which are based and registered in the UK (each a “Sailing Club) that is affiliated with the RYA or a member club of BUSA. All Sailing Clubs must nominate a lead person who is responsible for submitting the Sailing Club’s entry into this competition and who shall be responsible for liaising with the Promoter in respect of this competition (“Lead Person”). The Lead Person must be a member of the Sailing Club and must have the authority to enter this competition on behalf of the Sailing Club. The Lead Person must be 18 years of age or older. The Promoter reserves the right to ask for proof of age, residence, eligibility or membership of the Sailing Club. Employees and immediate family (defined as parents, children, siblings, spouse and life partners) of the Promoter or its affiliates, subsidiaries, advertising or promotion agencies are not eligible to enter this competition and/or be the Lead Person in respect of this competition.
- Entry Form: To enter the competition the Lead Person must go online to https://www.sunsail.com/uk/funding-the-future and complete the online entry form.
- All Entry Forms must include all of the information specified therein which includes (without limitation):
a) the Lead Person’s name, email address, postal address, and telephone number and the name of the Sailing Club which they are submitting the Entry Form on behalf of;
b) a summary of no more than 500-words which outlines how the Sailing Club proposes to utilise the Prize (as defined below) if they are successful;
c) a photograph of the Sailing Club which will be used to announce the winner subject to the terms of these Terms and Conditions; and
d) any other information which is expressly stated on the Entry Form. - No entries from agents or third parties or entries automatically generated will be accepted. Incomplete entries will not be accepted. Entries will only be accepted if they comply with all entry instructions. Each Sailing Club may only submit one entry to this competition.
- Use of Data: All details provided by the Lead Person, or anybody else from the Sailing Club in respect of this competition, will be held by the Promoter and used in accordance with these Terms and Conditions and the Promoter’s privacy policy available at https://www.sunsail.com/uk/choosing-sunsail/legals/privacy. The Lead Person, on behalf of the Sailing Club, shall ensure that to the extent that they submit any personal data (including without limitation any likeness contained in any photography) of any members of the Sailing Club that it has such members consent to share such personal data with the Promoter.
- Dates: The competition opens at 9.00 am on Monday 24th June 2024 (BST) and closes at 11:59 pm (BST) on Wednesday 31st July 2024. All entries must be received by 11:59 pm (BST) on the end date.
- Receipt of Entries: The Promoter cannot be held responsible for network, computer or software failures of any kind, which may restrict or delay the sending or receipt of the Sailing Club’s entry. The Promoter is not responsible for entries not received and/or any lost entries. The Promoter reserves the right (in its absolute discretion) to reject entries and disqualify entrants, including without limitation where the Promoter has cause to believe that (i) there has been a breach of these Terms and Conditions or (ii) the Lead Person and/or the Sailing Club has interfered with the fair running of this competition, including without limitation by manipulating entries or the results, or has provided false information or has acted unethically in any other way.
- Prize(s): The prizes which are available to be won under this competition are:
a) one (1) first place prize of a grant of up to the maximum sum of six thousand pounds (£6,000) exclusive of VAT and any other applicable taxes, which must be used by the winner in implementing some or all of their ideas for using the prize as set out in their Entry Form; and
b) two (2) separate runner-up prizes of a grant of up to the maximum sum of two thousand pounds (£2,000) each. The 2 runner-up prizes are exclusive of VAT and any other applicable taxes, which must be used by the runners-up in implementing some or all of their ideas for using the prize as set out in their Entry Form. - Each of the winner prize and the 2 runner-up prizes are collectively referred to as the “Prizes” in these Terms & Conditions.
- The Promoter will make payments up to an aggregate maximum of £6,000 for the winner, and £2,000 for each runner-up, in furtherance of the projects set out in their respective competition submissions per their Entry Forms. In order to benefit from and utilise any of the Prizes, the winner and runners-up must submit invoices to the Promoter, or get any suppliers to submit their invoices, direct to the Promoter. The Promoter reserves the right to refuse any invoices and withhold any payments in the event that it, in its sole discretion, considers such invoices or prospective payments to be contrary to the spirit of this competition and in the event that the payment would not be in accordance with the winner and/or runners-up Entry Forms.
- The Promoter is only able to pay valid VAT invoices which are addressed to Mariner International Travel (UK) Limited at Platinum House, St Mark’s Hill, London, KT6 4BH and which are issued direct from the supplier, not the Sailing Club, to the Promoter.
- In the event that the Promoter, in its sole discretion, has cause to believe that the Prizes are not being used for the purposes as set out in the winner or the runners-up respective Entry Forms, the Promoter reserves the right to decline to make payment of any, or all, of the Prizes so claimed by the winner and/or the runners-up.
- Anything which is not expressly set out in these Terms and Conditions is not included within the Prizes. The Prizes cannot be awarded to any person, company, entity, association, charity, non-profit organization, club or any other body whatsoever who, for any reason, would not be allowed by law to purchase or use the Prizes. No compensation will be payable by the Promoter if the winner or runners-up are unable to use their Prize as stated.
- The winners and the runners-up are not allowed to sell, transfer, or auction the Prizes on to a third party and no alternative will be offered. Use of the Prizes may be subject to additional terms and conditions imposed by the Promoter or any other organisation in connection with this competition.
- For the avoidance of doubt the winners and the runners-up of the Prizes are solely responsible for all additional costs and expenses associated with the Prizes which are not stated in these Terms and Conditions.
- Selection of winner: The winners and the runners-up will be chosen by a panel of three (3) judges on or before 6th September 2024.
- Notification:
a) The winner of the competition shall also be provided with two (2) complementary tickets to the Southampton Boat Show which is scheduled to take place on Friday 13th September 2024. The winner will be notified as soon as possible (and in any event at least 7 days prior) ahead of the Southampton Boat Show so that they can arrange for transportation and attendance to the Boat Show. Any transportation costs shall be at the expense of the Sailing Club. The Sailing Club will then be formally announced as the winner at the Southampton Boat Show and these complementary tickets are provided to the winner in order for them to be present at the announcement to collect their Prize. However, in the event that any representatives of the winning Sail Club are not available to attend the Southampton Boat Show to collect the winning Prize this shall not affect its entitlement to the Prize.
b) In the event that anybody from the Sailing Club that is the winner of the competition is not able to attend the Southampton Boat Show then the winner shall work with the Promoter to arrange alternative arrangements for the Promoter to announce the winner at the Southampton Boat Show (such as, by way of example only, joining the announcement by video link).
c)The runners-up of the competition shall be notified on Friday 13th September 2024 at the Southampton Boat Show. The timings of the announcement of the outcome of this competition will be driven by, amongst other things, logistical and scheduling arrangements at the Southampton Boat Show which are outside of the control of the Promoter. - The accuracy of any email address, address or phone number provided is the responsibility of the Lead Person. If the winner and/or the runners-up cannot be contacted or are unable to accept their Prizes, the Promoter reserves the right to choose another winner and/or runners-up from the eligible entries received. The Promoter shall make all reasonable efforts to contact the winners and runners-up. Acknowledgement of the Prize by the winner must be received by the Promoter by 5.00 pm (BST) on Friday 27th September 2024. Should the Promoter not receive confirmation from the winners and/or the runners-up by this time, or in the event that the winners and/or runners-up are unreachable or ineligible or declines to accept the Prizes, or a substitute winner and/or substitute runners-up fails to acknowledge the Prizes as specified by the Promoter, the relevant Prize shall be forfeited and the Promoter reserves the right to award any of the Prizes to another eligible entrant, based upon the process as set out in accordance with these Terms and Conditions.
- Winner details: Details of the Sailing Clubs that won and came runners-up in the competition, will be obtainable after Monday 16th September 2024 by writing to the Promoter’s address specified in paragraph 1 above quoting ‘Winners: Funding the Future Competition’. The winners and the runners-up may be required to participate in post-competition publicity.
- General: The Promoter reserves the right to amend the competition in exceptional circumstances. All entrants agree to abide by these Terms and Conditions and the Promoter reserves the right to exclude entrants for any breach of these Terms and Conditions. The Promoter’s decision is final, and no correspondence will be entered in to.
- The Promoter may use photographs, names, and the town/city of the winners and/or the runners-up in future publications and publicity, and may require the winners and the runners-up to take part in promotional publicity as specified by the Promoter, including without limitation being filmed, interviews, photoshoots etc. By entering the competition, in consideration of the Promoter providing the competition and the Prizes, the winner agrees to take part in such publicity and grants a worldwide, perpetual, irrevocable, unconditional and royalty-free licence to the Promoter and all necessary rights and consents for the full period of any intellectual property rights to use the winner’s and runners-up photographs, videos, voice, likeness and/or image, and the name of the winners and any runners-up in any media without further payment or permission, for any future promotional activity. For the avoidance of doubt, this licence shall also extend to any logos or branding materials of the winners and/or the runners-up. As per the provisions of paragraph 6 above the Lead Person, on behalf of the Sailing Club, confirms that they have all necessary consents from any members of the Sailing Club to provide any personal data which is included in any photographs, videos or any other materials whatsoever.
- The Promoter reserves the right to modify, suspend, cancel or terminate the competition for any reason, extend or resume the entry period, or change or withdraw the Prizes at any time without giving advance notice and will do so if an event occurs that renders the competition itself or the awarding of the Prizes impossible due to reasons beyond the control of the Promoter (including without limitation reasons which are unforeseeable by the Promoter at the time of running the competition) or if it cannot be guaranteed that the competition can be carried out fairly or correctly for technical, legal or other reasons and the entrant agrees that no liability shall attach to the Promoter as a result thereof.
- The Promoter has arranged the competition in good faith but, to the fullest extent permitted by law, accepts no responsibility for and will not be liable for any claims, costs, losses, damages, expenses or liabilities, of any kind (including without limitation direct, indirect, consequential, incidental or punitive damages) arising out of or in connection with the competition or with the acceptance, possession, use or any other aspect of the Prizes awarded. Nothing in these Terms and Conditions limits or excludes the liability of the Promoter for death or personal injury resulting from the Promoter’s negligence or for any damage or liability incurred by the entrant as a result of fraud or fraudulent misrepresentation by the Promoter or otherwise as prohibited by law.
- These Terms and Conditions are governed by English law and the Promoter and the entrant hereby submit to the exclusive jurisdiction of the English Courts.
